1. Acceptance of Terms

By accessing or using Vidmomo ("the Service"), operated by Vidmomo ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

The Service is available at vidmomo.com and app.vidmomo.com.

2. Description of Service

Vidmomo is an AI-powered video generation platform that enables users to create videos from text descriptions (text-to-video) and images (image-to-video). The Service utilizes third-party AI models to generate video content based on user-provided prompts.

3. User Accounts

  • You may access certain features of the Service without creating an account. Registration is available through Google OAuth 2.0.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must be at least 18 years old to use the Service.
  • You agree to provide accurate, current, and complete information.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credits and Payments

  • The Service uses a credit-based system. 1 credit = $0.10 USD.
  • New users receive complimentary credits upon first session (10 credits).
  • Credits can be purchased via PayPal. Available packages: Basic ($20/200 credits), Plus ($50/550 credits with 10% bonus), and Pro ($100/1200 credits with 20% bonus).
  • First-time purchasers receive an additional 20% bonus on all packages.
  • All purchases are final. Credits are non-refundable.
  • Credits do not expire as long as your account remains active.
  • If a video generation fails, the credits spent will be automatically refunded to your balance.

5. Acceptable Use

You agree NOT to use the Service to:

  • Generate content that promotes violence, terrorism, or illegal activities.
  • Create deepfakes or misleading content impersonating real individuals without consent.
  • Produce child sexual abuse material (CSAM) or content exploiting minors in any way.
  • Generate content that infringes on third-party intellectual property rights.
  • Attempt to circumvent rate limits, access controls, or security measures.
  • Use automated scripts, bots, or scrapers to access the Service without authorization.
  • Resell, redistribute, or sublicense access to the Service without prior written consent.

6. Content Ownership and License

  • Your Inputs: You retain ownership of text prompts and images you provide to the Service.
  • Generated Content: Subject to these Terms, you own the output videos generated by the Service for your personal or commercial use.
  • License to Us: By using the Service, you grant us a non-exclusive, royalty-free license to process your inputs solely for the purpose of providing the Service.
  • Public Content: If you choose to make generated videos public, other users may view them through our explore gallery. You may set videos to private at any time.

7. NSFW Content Policy

  • Certain AI models may generate adult (NSFW) content. Access to NSFW models is restricted and requires age verification.
  • NSFW-generated videos are private by default and cannot be made public.
  • Users accessing NSFW features confirm they are at least 18 years old and reside in a jurisdiction where such content is legal.
  • We reserve the right to restrict NSFW access at any time without notice.

8. Intellectual Property

The Service, including its user interface, design, logos, and underlying technology, is owned by Vidmomo and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our express written permission.

9. Third-Party Services

The Service relies on third-party AI providers for video generation and third-party payment processors for payment processing. We are not responsible for the availability, accuracy, or policies of these third-party services. Their respective terms and privacy policies also apply.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

  • We do not guarantee that the Service will be uninterrupted, error-free, or secure.
  • We do not guarantee the quality, accuracy, or suitability of AI-generated content.
  • Generation times and results may vary depending on demand and model availability.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDMOMO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service;
  • Any unauthorized access to or alteration of your content;
  • Any content generated by the AI models;
  • Any interruption or cessation of the Service.

Our total aggregate liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Vidmomo, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

  • We may terminate or suspend your access to the Service at any time for violations of these Terms.
  • Upon termination, your right to use the Service ceases immediately.
  • Unused credits are non-refundable upon termination.
  • Sections regarding liability, indemnification, and intellectual property survive termination.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the website. Continued use of the Service after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
